Rankin County Workers' Compensation

Workers’ Compensation Attorneys in Rankin County

Our Skilled Lawyers Help You With Your Claim, From Start to Finish

Workplace injuries happen every day. To protect themselves and their employees, most employers carry workers’ compensation insurance. This no-fault insurance covers the costs associated with medical care and recovery time whenever someone is injured or develops an occupational illness at work. In Rankin County and the rest of Mississippi, all employers with 5 or more regular employees must carry workers’ compensation insurance. If an employer has less than 5 employees, this insurance is optional, but most businesses prefer to carry workers’ comp regardless.

While workers’ compensation can protect employers from liability, policies can also be expensive to maintain, especially if workers use their benefits frequently. As a result, some employers try to dissuade their employees from filing claims. Not only is this a felony, but willfully making false or misleading statements to withhold workers’ comp benefits can lead to civil lawsuits.

Even when claims go a step further, insurance companies can create problems. When this occurs, injured workers must deal with the Mississippi Workers’ Compensation Commission (MWCC).

If you are facing employer misconduct surrounding workers’ comp or addressing your claim with the MWCC, you might need an attorney. Our legal team at ‘Maggio | Thompson, LLP is here for you.

What Does Workers’ Comp Cover?

Workers’ compensation insurance covers any injury you receive at work, no matter how slight or serious. If you are completing a work-related task when you get hurt, your injury will be covered, even if you are not physically at the workplace. Occupational illnesses and diseases are also covered.

Below are the injuries we see most often at our firm:

We also handle claims for maritime workers (offshore workers and seamen), which are handled under the Jones Act instead of state workers’ comp guidelines.

What Kinds of Benefits Am I Entitled To?

Injured workers are entitled to 2 basic benefits: medical care and wage loss.

Medical benefits cover all medical services required to treat your injury and maximize your recovery. Your hospital bills, doctor’s appointments, medication, physical therapy, and assistive devices should all be paid for by workers’ compensation. Further, your benefits should cover transportation to and from appointments.

Wage loss benefits address the time you need to take off work to fully recover from your injury. You will be paid up to 2/3 of your regular weekly income. These benefits are capped at a certain amount and can only last for a predetermined amount of time. While you are being treated by a doctor, these benefits are known as “temporary disability payments,” but once a medical professional finds you have achieved maximum cure or improvement, you will receive “permanent disability payments.”

For these benefits, you must be paid every 14 days.

If you face difficulties receiving medical or wage loss benefits, our Rankin County workers’ compensation lawyers can help.

Are Workplace Deaths Covered?

Yes. Workers’ compensation insurance will cover up to $5,000 of funeral expenses, an immediate lump sum payment of $1,000 to the surviving spouse, and weekly benefits for up to 450 weeks after the decedent’s death. Only surviving spouses and certain surviving dependents (i.e. children) are entitled to these benefits, which will equal a percentage of the deceased workers’ regular weekly wages.
