What questions will an auto accident attorney ask about your case?

We know that the time after a crash is precious. You might feel overwhelmed at the next steps, especially if medical treatment is involved. 

One thing we get asked most frequently about auto accidents is how to prepare for a consultation. For all accident victims in our areas of practice, we offer a free, no-obligation consultation. 

When we schedule a time to talk with you, here are a few things to keep in mind that we may ask. This list isn’t exhaustive by any means. 

It does, however, give you an idea of what to expect during your initial auto accident consultation. 

Just remember the 5 Ws and an H: 


  • Who was involved in the accident? We want to know the names of any passengers who might have been in your vehicle, as well. Witnesses can be crucial to your case.
  • Were any pedestrians involved? Again, these pedestrians may be critical witnesses for your case. 
  • Were the police called? If so, did they file a report? 


  • What type of auto-accident occurred? 
  • What types of injuries occurred, if any? From minor to life-threatening, we want to hear. 


  • When did the crash happen? What time of day did the accident take place? Daylight (or lack thereof) can play a factor in a crash. 
  • What were the weather conditions that day? Do you think the weather was to blame? 
  • What was the exact date? You’d be surprised how many people have a difficult time remembering dates. Try to write down WHEN the accident happened. 
  • Did you receive medical care? If so, how soon after the accident?


  • Where were you when the accident took place? Street names and specific locations are helpful. 
  • Where did you go after the accident? Were you transported for medical care? Was it by ambulance or did you drive yourself? 


  • Why did the accident take place? With this question, we’re looking at potential faults, including whether or not anyone admitted fault. 


  • In your words, how exactly did the accident happen? Even if there is a police report on file, we still want to hear your point of view. 

Other types of information to have on hand

During an initial consultation, you should also be able to provide information regarding insurance coverage, any other medical details worth noting, and what types of conversations you’ve had with your insurer since the accident.
