In short, Mr. Robbins is a hardworking gentleman who was injured while working for his employer, Howard Industries, Inc. Although Mr. Robbins had returned to work (making more money than he had at the time of injury), the Workers’ Compensation Commission determined that he was entitled to a larger monetary award than what his impairment rating would have otherwise allowed. In part, this was because Mr. Robbins’s injury was so significantly injured that he was unable to return to the same type of work he had previously performed – even though he still worked for his same employer.
