Guiding You Through the Workers’ Comp Process

Getting hurt at work can be scary. Not only are you facing injuries, but you may also be looking at medical bills and unable to make a living while you recover. Fortunately, officials in Madison, MS and the rest of Mississippi understand this struggle and the state mandates employers with 5 or more employees carry workers’ compensation insurance.

Unfortunately, employers and insurers don’t always honor workers’ compensation claims and the Mississippi Workers’ Compensation Commission (MWCC) can be notoriously hard to deal with.

Most of the time, employees receive workers’ comp benefits without a problem. Sometimes, claims are a little more complex.

If you fall into the latter category and are struggling to obtain the benefits you are entitled to, 'MAGGIO LAW can help. Call us at (601) 265-6869today to get started.

What Is Workers’ Compensation?

Workers’ compensation is no-fault insurance that your employer pays for. If you get hurt at work, this insurance will cover the expenses associated with your treatment and recovery. This includes medical and rehabilitative appointments, transportation to and from healthcare providers, and missed wages.

Unlike personal injury claims, workers’ comp claims do not account for pain and suffering or other non-economic damages. If you believe your workplace accident was caused by negligence, especially the negligence of a third party, a lawsuit may be more appropriate.

What Kinds of Accidents Are Covered Under Workers’ Comp?

Any injury that occurs at work or while you’re completing work-related tasks is covered under workers’ compensation insurance, no matter how big or how small. Worker’s comp also covers occupational diseases or illnesses and allows benefits for the surviving spouse and dependents in the case of a workplace death.

At our firm, the claims we see most frequently include:

  • Work-related car accidents
  • Slips, trips, and falls at work
  • Construction accidents
  • Back injuries
  • Chronic pain
  • Strains and sprains
  • Overuse or overexertion injuries
  • Carpal tunnel syndrome
  • Repetitive stress injuries (RSIs)
  • Electrical accidents
  • Fires and explosions
  • Chemical exposure
  • Silicosis and asbestosis
  • Hearing and vision loss
  • Acts of violence in the workplace
  • Occupational illnesses and diseases

Accidents and injuries that happen at sea or in the military typically transcend state law and are handled at the federal level. Maritime workers, for example, are covered by the Jones Act. For injuries that prevent you from working, you may also be eligible for Social Security Disability Insurance.

No matter your situation, ‘MAGGIO LAW, can help you recover full and fair compensation.

How Does Workers’ Compensation Work?

If you get injured at work, the first things you should do are notify your supervisor and seek medical attention. Keep in mind, you must notify your employer of your injury within 30 days to be eligible for workers’ comp insurance.

From there, your employer will notify its insurance company and/or the MWCC. If your claim is approved, you will start receiving benefits for medical care and missed wages.

Medical benefits cover all the services you need to achieve maximum cure. This includes hospitalization, doctor’s visits, nursing services, medication, physical therapy, assistive devices, and more. You can also use these benefits to cover the costs of transportation to and from medical appointments

Wage loss benefits cover any work you miss in excess of 5 days. You will receive 2/3 of your regular weekly pay every 14 days until you reach a legally established time limit. If you are able to recover from your injuries, these benefits are known as “temporary disability payments,” but if you are still unable to work at the same level after your treatment, you may receive “permanent disability payments.”

If your injuries are fatal, death benefits will cover the cost of your funeral and help support your family for up to 450 weeks after your death.
