How Does the System Work?

Mississippi’s workers’ comp system was designed to provide financial relief for injured workers—and protect employers from personal injury lawsuits. It can be very challenging to ensure you are awarded the benefits you deserve after suffering a severe or catastrophic injury or to recover survivor’s benefits for a family who has lost a loved one. At ‘Maggio Law, we are dedicated to protecting the rights of injured workers and helping them fight for the compensation they are due under the program.

How Much Is an Injured Worker Due in Benefits in Mississippi?

The workers comp system pays injured workers two types of benefits:

  • Medical Benefits: The system works to pay for medical care, including hospital services, nursing services, medications, physical therapy, and other medical needs. The cost of transportation to the doctor is also paid to a specific level. For life-altering injuries that leave the worker unable to perform their former duties, rehabilitation services are offered to assist in recovery and a way to return to the workforce in some capacity.
  • Lost Wage Benefits: When the injuries sustained on the job make it impossible to work, the system pays a wage loss benefit of two-thirds of the pay they earned for a specified time, with limits on the value of the benefits paid, called a “temporary disability” payment. Additional wage loss benefits can be paid for “permanent disability” when the worker is permanently disabled due to a work accident.
  • Vocational Rehabilitation: Assistance with retraining or finding suitable employment for those unable to return to their former duties.
  • Death Benefits: Financial support for dependents when a workplace injury has resulted in the death of a loved one.

What To Do After a Workplace Injury?

After an injury at work, specific steps are required, including the following:

  • Report the injury to your supervisor. In many cases, the injuries are so severe that it is impossible to file a report, and the injured worker must just be quickly transferred to the ER for lifesaving treatments.
  • Undergo all medical treatments the doctor advises. Whether surgery or other treatment, undergo all treatments. Failure to follow your doctor’s advice can lead to difficulties in getting a valid claim paid.

What Are the Serious Workplace Injuries in Mississippi?

A workplace injury includes physical and emotional damage resulting from another party’s carelessness, negligence, or wrongful conduct. Workers in Mississippi face many risks while at work. Common injuries that may qualify for workers’ compensation include the following very serious or disabling injuries:

Back Injuries

These injuries are to workers who lift heavy items and perform repetitive motions.

Spinal Cord Injuries

These can have life-altering consequences, including paralysis, chronic pain, affecting mobility and quality of life. Spinal cord injuries can result from workplace accidents, work-vehicle collisions, or falls.

Head and Brain Injuries

These life-altering injuries can result from equipment accidents, falls, or struck-by accidents, often occurring in the construction industry. A brain injury may leave the victim with physical and cognitive impairments or, in the worst cases, in a vegetative state.

Occupational Illnesses

These illnesses can occur due to exposure to toxins, chemicals, or hazardous fumes, causing ongoing respiratory issues, cancer, or other diseases.

Fractures and Dislocations

Caused by slips, trips, falls, equipment malfunctions, transportation accidents, and caught in or between stationary objects.

Burns and Lacerations

These injuries often occur in construction, manufacturing, or other high-risk industries.

Amputations

A crush injury, fall, or vehicle accident can damage a limb so severely that it must be amputated.

Electrocution Accidents

These are among the most severe workplace injuries, often resulting in burns, nerve damage, cardiac arrest, or loss of life. These injuries most commonly occur in construction or industrial settings due to a lack of required safety protocols.

Crush Accidents

Crush accidents can lead to devastating injuries, including broken bones, internal organ damage, or amputations. These incidents often occur in construction zones, warehouses, or manufacturing facilities when heavy machinery or falling objects are involved.

Do I Need a Workers’ Compensation Lawyer?

While workers’ compensation is intended to be a straightforward system, many injured workers encounter serious problems getting the benefits they deserve, including the following situations:

  • Denied Claims: A legitimate claim could be denied, leaving you struggling to survive and needing to file an appeal—a complicated process to manage on your own.
  • Disputed Injuries: Employers or insurers may argue that your injury didn’t happen at work or was not severe enough to qualify.
  • Inadequate Benefits: Insurance providers may offer lower benefit payments than you are entitled to receive under the program, leaving you unable to pay your expenses.
  • Retaliation: Some employers may unlawfully retaliate against employees who file workers’ compensation claims, such as through termination or reduced hours.

An experienced workers’ compensation lawyer can help you navigate these challenges, protect your rights, and help you fight for the benefits you deserve under the law.
