Compensation for Unsafe Vaccine Side Effects
Vaccines are amazing medical tools used to protect the individual and the overall public health from dangerous diseases and viruses. However, no medical treatment is guaranteed to be without risk, and vaccines are no exception. Some people who are given a tried-and-true vaccine can still suffer unsafe and harmful side effects*.
If you took a vaccine and suffered an injury due to it, then you might be eligible to receive compensation through the National Vaccine Injury Compensation Program (VICP). ‘MAGGIO LAW can help you understand your options and file your claim for financial benefits if your vaccine injury does qualify. Our vaccine injury lawyers are here to answer all of your questions, make you feel at ease as your claim is progressed, and ensure you have a fair chance of getting the compensation you deserve.

How Does the VICP Work?
The VICP was created to give people a way to receive compensation after being hurt by certain vaccines, all of which have been recommended by the Centers for Disease Control and Prevention (CDC) for “routine administration to children or pregnant women” or that has been “subjected to an excise tax by federal law.”
Vaccines currently recognized by the VICP include the following and more:
- Hepatitis A/B
- Diphtheria
- HPV
- Seasonal influenza
- Measles
- Mumps
- Rotavirus
- Polio
- Tetanus
- COVID-19
Additionally, the patient who received the vaccine must exhibit certain injuries or symptoms within a specific time period, which varies based on the vaccination they received. If the symptoms occur after this time period ends, then it is assumed that the vaccine did not cause the injury, and the Health Resources & Services Administration (HRSA) will challenge the claim. If your claim is challenged, then we will be ready to return with answers and further inquiries to pursue the money you are owed.
How Much Compensation Can You Receive?
The National Vaccine Injury Compensation Program is highly regulated. Not only does it strictly limit what vaccine injuries can be compensated through it, but it also regulates how much compensation a claimant can receive. The amount of compensation you can get through the VICP will vary based on the vaccine you took and the extent of your injuries, but it will mostly be a preset amount. Our attorneys can help ensure that you do receive the fullest amount possible.
Can You Sue the Pharmaceutical Company?
If a pharmaceutical company made the vaccine you took, then can you sue it for your vaccine injuries? In most cases, you cannot. In an effort to encourage pharmaceutical companies to produce affordable vaccines in large quantities, scores of legislative measures have been taken to shield those companies from essentially all liability if something goes wrong and a vaccine user is hurt. The liability protection afforded to pharmaceutical companies that produce vaccines is one of the main reasons why the VICP was established in the first place.
